TUCSON, AZ (Tucson News Now) -

A Tucson man is suing the grocery store chain Fry's because he said it is short-changing customers when it comes to gallons of ice cream.

Gerald Morris said he looked into it, and although the containers say they are 48 ounces, some are 39, 37 or even just 29 ounces, depending on the ice cream flavor.    

He said he took the issue to Fry's management 18 different times but nothing changed so he filed the lawsuit in small claims court.

He said it isn't about the money; he's willing to spend the same amount he's suing for, just to have the problem fixed.
