The victim told police that she was walking home from a store when Mitchell approached her and made an explicit sexual advance toward her. The victim told police that after she refuse, the suspect grabbed her, took her behind a nearby house and sexually assaulted her.

Following the assault, the victim was able to flee to a nearby home where she called police. She told investigators that she knew the suspect as Cody from the neighborhood.
