AL death row inmate may get new trial

An Alabama inmate, who has been on Death Row for 28 years, might get a new trial after the U.S. Supreme Court ruled that his trial counsel was inadequate.

The court issued an opinion on Monday saying that Anthony Ray Hinton's counsel during his trial was constitutionally deficient.

Hinton was charged in 1985 with two murders during separate robberies at fast-food restaurants in Birmingham. Prosecutors linked Hinton to the murders through a .38-caliber revolver that was recovered at his house.

Hinton's lawyer wrongly thought that he only had $1,000 to hire a ballistics expert. Hinton's lawyer hired the only person willing to take the job at such a low price, even thought he thought the expert was inadequate.

The court sent the case back to the Alabama state court to consider if Hinton should get a new trial.
