Kentucky Attorney General will not appeal same-sex marriage ruling

LOUISVILLE, KY (WAVE) - Kentucky Attorney General Jack Conway announced on Tuesday that he will not appeal U.S. District Judge John Heyburn's ruling ordering the state to recognize same-sex marriages performed outside Kentucky.

"Judge Heyburn got it right," Conway said.

The Commonwealth's top chief lawyer said he had heard from many across the state who want him to continue to fight the ruling through the appellate process.

"I came to the inescapable conclusion that if I did so, I would be defending discrimination," Conway said. "That I will not do."

Conway became emotional toward the end of his statement when thanking those who providing him with counsel in making his decision, particularly his wife.
