MONTGOMERY, AL (WSFA) -

An employee with the Alabama Department of Finance is under arrest and charged with state tax evasion, according to Alabama Attorney General Luther Strange and State Revenue Commissioner Julie Magee.

A Montgomery County grand jury indicted 48-year-old Judy Smith Horn on three counts of income tax evasion. She surrendered to the Montgomery County Sheriff's Dept. Thursday. She was later released on a $5,000 bond.

Horn is a departmental operations specialist with the Finance Dept. The allegations against her are that no Alabama income tax was withheld from her paychecks in 2008-2010.

If convicted, Horn could face up to five years in prison and $100,000 in fines on each count.
