HUNTSVILLE, AL (WAFF) -

After several cancellations, the suspect in Huntsville's first murder of 2014 is set to appear in court Monday.

Lopez Rice is accused of killing Mercedes Morris on New Year's Day. Police said Rice and several others went up to a home on Bridge Road and opened fire.

Morris was in a car in the driveway and got hit by the flying bullets.

Rice's preliminary hearing was set for January but was delayed because of a winter storm. It was re-scheduled for last week, but was again delayed because an investigator in the case was out of town.

He is scheduled to appear in court Monday at 2 p.m.
