HARVEST, AL (WAFF) -

State Troopers said the driver of a vehicle that hit a Madison County student seconds after he stepped off a school bus will not face any criminal charges.

The child was hit at the intersection of Vanguard Street and Trailing Vine Lane in Harvest around 1 p.m.

School officials said the student attends Endeavour Elementary and is okay.

Witnesses said several students got off the bus at the intersection in the middle of a neighborhood. They said the bus driver had his flashers on and the stop sign was out when an SUV pulled in front of the bus and hit one of the children.

According to witnesses at the scene, the victim bounced off the ground when the vehicle hit him. Several parents rushed to the scene after watching it unfold.

The driver of the SUV pulled off to the side of the road after the collision. Parents confronted the female driver and a male passenger after the wreck.

"She goes too fast in our neighborhood," said one parent. "She's going to kill one of our kids. She already hit one today."

A witness said the child suffered a broken leg and was taken to a local hospital. The driver has not been charged.

According to bus stop laws:

  • On a two lane road or a four lane road with no median, traffic from both directions must stop.
  • If it's a four lane road with a median, only the traffic following the school bus has to stop.
  • If you're caught illegally passing a school bus, you will face a fine of $150 to $300.
  • The second and third offenses are higher and can get up to $1,000.
  • Your license could be suspended, and you'll have to do community service.
State troopers did not say why the driver won't face charges.
