Woman files 'no contact' order against son's elementary school bully

TUCSON, AZ (Tucson News Now) -

The mother of an elementary school student in Tucson has filed for an order of injunction against her son's alleged bully.

Dawn Benson said her son had mentioned being bullied by a girl at Ventana Vista Elementary School before, but a recent case that left him bleeding caused Benson to take action.

She said she contacted staff at the school, only to be told that her son and his alleged bully had been separated. Benson said that wasn't enough and she did not feel comfortable letting her son go back to class.

"He says 'Mom, I just don't feel like I can be safe there,'" she said. "And I don't know how you send a child into that."

A judge signed off on the paperwork for a distance of 20 feet, according to Benson's copies. Juvenile Court confirms that paperwork had been served to the parents of the other student involved.

Benson said she has not tried working the situation out with the girl's parents, nor has she met them. She said the school did not help, so she went to court.

"It's the next logical step," said Benson.

Administrators handled the situation properly, according to a statement from Catalina Foothills School District. The assistant superintendent said the boundary of 20 feet was already being monitored before the paperwork was filed.

The district takes allegations of bullying seriously, according to a statement. This is the first time someone has filed a no contact order like this in Catalina Foothills School District.

"There doesn't seem to even be an awareness that there is a problem," said Benson.

Her husband now stands on the corner of the school to share their story with parents passing him by. Parents picking up their children at the school on Tuesday afternoon were split on the idea of bullying at Ventana Vista Elementary.

"Not at all," said one father. "I just talked about it with my kid… two days ago and he said nothing's going on."

"I'm not going to deny that it's happening," said a mother whose daughter had plenty to say. "I've seen two kids leave this school because of bullying," she said. "And this one girl just puts her head down and cries."

Benson pulled her son from the school and will enroll him in a different one next year. She said her mistake in this situation was not doing something about it sooner.

"That would be my caution to anyone," she said. "Don't let it go on very long."
