MONTGOMERY, AL (WSFA) -

A judge is granting a motion that lifts the order that is blocking the Alabama Accountability Act while an appeal is pending.

Montgomery County Circuit Judge Gene Reese declared the AAA unconstitutional, but the State is appealing the decision to the Alabama Supreme Court.

Monday's order means that scholarship and tax credit programs can continue while the ruling is appealed.

The Accountability Act provides tax credits for parents who move their children from failing public schools to private schools.

"I am pleased that the Montgomery Circuit Court has stayed its injunction against the Accountability Act," Attorney General Luther Strange's office said, adding, "My Office will continue to seek reversal of the court's ruling."
