ELMORE COUNTY, AL (WBRC) -

A former Tutwiler Prison sergeant charged with custodial sexual misconduct last year is going to trial on Tuesday at the Elmore County Criminal Courthouse.

Matthew Hall, 33, of Montgomery, is accused of kissing and fondling a death row inmate.

Hall has pleaded not guilty to the charge. He was indicted in April 2013. He is no longer an Alabama Department of Corrections employee.

FOX6 was the first media out let to report on conditions at Tutwiler, described in a complaint sent to the Department of Justice by the Equal Justice Initiative in 2012.

The U.S. Department of Justice issued a report in January blasting conditions at the women's prison, alleging that inmates were sexually harassed and sexually abused by guards for almost 20 years.

To date, six cases involving sexual misconduct of guards have been successfully prosecuted.
