Parents of Gil Collar file federal lawsuit

MONTGOMERY, AL (WSFA) -

The family of Gil Collar, the University of South Alabama student who was shot and killed on campus in October of 2012, filed a federal lawsuit Monday against the campus police officer involved in the shooting.

According to court documents filed by the Collar family on July 25, Officer Travis Austin is being sued for the wrongful death of their loved one.

The documents state that Austin had full knowledge or objectively should have known, based on his position as a campus police officer, that Collar was unarmed and in a state of distress and disorientation. The suit contends that the student was not a threat.

On Friday, a judge granted the family's request to dismiss a suit they were pursuing in state court. The family's attorney then announced plans to file the federal civil rights suit.

According to authorities, Collar, a Wetumpka native, was naked and under the influence of LSD when the shooting occurred early that Saturday morning when he allegedly came at the officer in an aggressive manner.
