Complaint filed against federal judge accused of domestic violence

BIRMINGHAM, AL (WBRC) -

An Alabama federal judge facing a criminal battery charges involving his wife now must contend with a complaint being filed against him by a high ranking federal judge.

U.S. District Judge Mark Fuller was arrested in an Atlanta hotel August 10. A police report says he hit wife and dragged her around the room after being confronted about an alleged affair.

Fuller's Birmingham attorney, Barry Ragsdale, confirms the Chief Judge of the Eleventh of Circuit Court of Appeals has filed an administrative complaint against Fuller.

Fuller must answer the charges. Ragsdale tells FOX6 News Fuller could face suspension or some sort of monetary penalty. Ragsdale said there is a possibility of recommendation for impeachment by Congress but that is rare and he doesn't expect it in this case.

The battery charge is a misdemeanor charge. Ragsdale says his client will check himself into a treatment program and will seek counseling.

A criminal court hearing was set for Friday but has been pushed by to September 5 in Atlanta.
