Final preparations made for Desmonte Leonard's trial

MONTGOMERY, AL (WSFA) -

Auburn mass shooting suspect, Desmonte Leonard was back in court on Monday as attorneys made the final preparations for his September trial.

Leonard is accused of fatally shooting three people and wounding three others at an off campus party in 2012.

The prosecution and the defense deliberated over jurors who petitioned the court to be excused from jury duty.

In all, the court summoned 250 residents to jury duty and based on the number of people excused for the September 22 trial, the prospective jury pool sits at approximately 200.

Those 200 jurors will receive a generic questionnaire that will help both parties prepare to strike a jury. On Monday, the defense proposed using a specific list of questions, but it received resistance from the prosecution.

"It appears the generic questionnaire goes out tomorrow, a decision will be made on our questionnaire later," said Defense attorney Susan James. "Sometimes in these type cases it's so obvious that a particular juror couldn't be fair, once they are asked those tough questions there's a possibility that mathematically we have to request more jurors to come in."

It could take as long as a week to strike a jury, and even then a change in venue is very much on the table.
