AL Supreme Court rules capital murder suspect can be held without bond

LIMESTONE COUNTY, AL (WAFF) -

The Alabama Supreme Court handed down a ruling on Friday stating capital murder suspect Joel Moyers can be held without bond pending trial.

Moyers is accused of shooting and killing Brandon Hydrick in September 2012. Investigators said Hydrick was a passenger in a vehicle. Moyers is accused of shooting into that vehicle, killing Hydrick.

In January 2013, the Limestone County district attorney notified the court the state does not plan to seek the death penalty in this case. Moyers filed a petition for bail August 2013. A Limestone County judge denied that request. Moyers filed an appeal with the Alabama Criminal Court of Appeals.

The Appeals court directed the trial judge to set bail for Moyers. The capital murder suspect posted a $275,000 bond in December 2013.

Limestone County District Attorney Brian Jones asked the Alabama Supreme Court to overturn the decision by the appeals court. The Supreme Court sided with the Limestone County District Attorney, stating “the trial court may deny Joel Patrick Moyers bail if the constitutional conditions are satisfied”.

A judge has ordered a bond hearing for Moyers be held on Tuesday, Sept. 2 at 1:30 p.m.
