Murder suspect's bond upheld pending re-hearing

LIMESTONE, AL (WAFF) -

An accused murderer will remain free from jail for the time being. The Limestone County District Attorney planned to ask the judge to revoke Joel Moyers' bond during a hearing held Tuesday.

However, that hearing was cut short, and the judge upheld Moyers' $275,000 bond - for now.

Joel Moyers' attorneys pointed out that the State Supreme Court decision is not a final order yet. There is time for the defense to apply for a re-hearing, and they intend to do that.

Moyers was not at Tuesday's hearing. 

He has been freed twice in the past: The first was shortly after his arrest and before his murder charge was upgraded to capital murder. The judge revoked his bond. 

The second occurrence was in December after an appeals court ruled that, because the DA is not seeking the death penalty, Moyers is eligible for bond. The State's high court ruling overturned that decision, and District Attorney Brian CT Jones plans to ask the judge to put Moyers back in jail without bond until his trial. 

But that will have to wait. The defense has 10 days to file the application for a re-hearing. The Supreme Court can reject it, and simply make the ruling official.

Moyers is charged with shooting and killing 26-year-old Brandon Hydrick in September of 20-12. Investigators said Hydrick and his his brother were driving on Fennel in Tanner when Moyers shot into their truck.

There has not been a date set for the trial yet.
