Attempted murder charges stand for man accused of pointing gun at Birmingham officers

BIRMINGHAM, AL (WBRC) -

Charges continue to stand against a man charged with the attempted murder of two Birmingham police officers.

Prosecutors say Aubrey Williams pointed a pistol at the officers when they approached him in an alley in April 2014.

On Thursday in court, Williams' attorney asked that the charges be dismissed, saying the dash cam video from one of the officer's cars does not show Williams pointing a pistol and contradicts the officers' statements.

"They know they don't have a case,” defense attorney Emory Anthony said.

"They know this man didn't point a gun at two people. They know the police officers lied. Just do what's right. That's all you have to do. Forget about what Edward vs. State says. What does common legal sense say? And that's what we should deal with," Anthony added.

Anthony says if anything, his client should have been charged with carrying a firearm, which is a misdemeanor.

Prosecutors argued by carrying a gun, Williams was in violation of his probation from three previous charges.
