Suit filed contesting Wetumpka councilman's election win

WETUMPKA, AL (WSFA) - Former Wetumpka City Councilor Lewis Washington, Sr. has filed a lawsuit against incumbent Percy Gill.

Washington, who lost in the Aug. 23 municipal election against Washington, is filing the suit on two grounds in an effort to contest the election.

Washington claims some people were allowed to vote who were not on the roll. Those voters should have been provided a provisional ballot, he contends. There were no provision ballots in the precinct that makes us District 2, however.

Washington also claims that "a sufficient number of legal votes" for him were illegally rejected in the election.

The win was by a very slim margin. On Aug. 30, the city council unanimously adopted the Canvas of Election results.Washington had 165 votes to Gill's 168, certifying the win for Gill.

Washington filed suit in Elmore County Circuit Court, asking the court to rule before Gill takes office on Nov. 7. He wants the court to declare him the winner of the election.
