Pharmaceutical giant Merck got hit with a big loss in a New Orleans courtroom yesterday. And a Montgomery law firm played a big part in that case. Beasley Allen's Andy Birchfield served as co-counsel during the trial. The case involved a retired FBI agent who suffered a heart attack after using the arthritis drug "Vioxx".
The jury found that the drug caused the heart attack.
Jere Beasley says the verdict from the jury sent a clear message to the drug company, "Merck was guilty of reprehensible conduct of the worse sort....that they had mislead the medical community, the public, as well as everybody concerned about the safety risk taking Vioxx."
Merck lost a $50 million dollar compensatory damage and a $1 million dollar punitive damage verdict.
Beasley adds, "Because they've ignored all the rules in so far as taking care of patient's needs and they put their own profits ahead of the safety and health of people taking their drugs."
