Capital murder charges against a man suspected of killing a 7-year-old boy have now been dropped.
Montgomery police released Darnell Addison from jail Thursday.
He was charged with capital murder in the New Year's Eve shooting death of Curtis Jackson.
Police say new information in the case has "diminished probable cause" in Addison's arrest.
Even though Addison cannot be eliminated as as suspect at this time, officials believe new developements in the case make it "inappropriate to allow the current charges to stand."
Witnesses on the scene told police investigators that Addison was firing a handgun into the air in celebration of the new year.
Police say their investigation continues with the goal of arresting the person responsible for the death of Curtis Jackson.
