Another Pedestrian Hit and Killed on Busy Southern Boulevard

Montgomery, Al. (WSFA) -- For the third time in 2008 Montgomery police are investigating the death of a pedestrian on the busy Southern Boulevard.

On Wednesday night a pedestrian was struck by two cars while crossing the multi-lane roadway.

The 47-year old victim died shortly after 10PM from injuries suffered in the accident.

The accident happened on the Boulevard between Rosa Parks Avenue and Court Street.

Police say no charges will be filed against the drivers, and that the victim's name will be released when his family is notified. 

Two other pedestrians lost their lives in 2008 attempting to cross over the roadway.

In January, Shirley and James Elmore of Hayneville were killed while attempting to cross the road at the 900 block of West South Boulevard.

Charges were not filed in that case either.

    The plaintiffs claim McDonald's has been "unjustly enriched" because customers have been paying for cheese they don't want.
