Appeals court upholds ex-JeffCo comish conviction

BIRMINGHAM, Ala. (AP) - A federal appeals court has upheld the conviction and sentence of former Jefferson County Commissioner Jeff Germany.

A federal jury convicted Germany in 2006 of misusing taxpayers' dollars.

He appealed his conviction on one count of conspiracy and four counts of misapplying government funds along with his three-year prison sentence.

Germany's appeal centered on issues of insufficient evidence, expired statute of limitations, defective indictment and also that his sentence was unreasonable.

A three-judge panel disagreed.

Germany began serving his 43-month sentence at the Federal Prison Camp Montgomery located on Maxwell Air Force Base in December 2006.

A jury convicted him of illegally funneling discretionary funds through social services agencies, then having new checks cut and the money passed on to other recipients he designated.
