BIRMINGHAM, Ala. (AP) - An Alabama football fan who won $5 million in a slander lawsuit against the NCAA has given up on collecting the money and will instead push for a new trial.
An attorney for Ray Keller said Monday the north Alabama timber dealer is now seeking a second trial in Jackson County.
A jury in Scottsboro awarded Keller $5 million in 2007.
The longtime Alabama booster accused the NCAA of slandering him in its investigation of the Crimson Tide football program in 2002.
A judge threw out the verdict and Keller appealed.
But he has now dropped the appeal, and attorney Don Word said Keller hopes for a second trial in Jackson County.
Word said it's possible that jurors could award Keller even more money in a retrial.
