CHILTON CO., AL (WSFA) - A former Chilton County Sheriff's deputy who also served as a school resource officer and teacher in the Chilton County school system has pleaded guilty to multiple charges including sexual relations with a student and rape. David Hubbard pleaded guilty to four counts of School Employee Engaging in a Sex Act with a Student Under 19, one count of second degree rape, and one county of Enticing a Child for Immoral Purposes.
Hubbard's plea agreement included crimes against six victims. The agreement recommends the maximum sentence of 20 years each for the four counts of teacher/student sex, the maximum sentence of 20 years for the rape count, and the maximum 10 year sentence on the enticement count. The State of Alabama is recommending Hubbard serve a 20 year sentence.
Hubbard and his wife, Rebecca, were arrested after multiple victims were discovered as part of a joint investigation between the Clanton Police Department, the Chilton County Sheriff's Department, and the District Attorney's Office in June 2014.
"To testify at trial would have been another assault on these young people. They, and their families, wanted to ensure Hubbard would never have the opportunity to work in law enforcement again," said District Attorney Randall Houston. "And this will provide them with that assurance. Hubbard not only abused the power he was given when he became an officer of the law, but he abused the trust of the public, which he swore to protect and serve. I will never understand, nor tolerate this type of behavior and lack of respect."
The investigation was originally opened after a June 19, 2014 three-car crash near the Jefferson State Community College Campus on AL Hwy. 145 claimed the life of an Alabaster man and injured two others. While officers were trying to figure out if alcohol played a role in the crash, they stumbled upon information that implicated then sheriff's deputy Hubbard and his wife.
The information led to the Hubbards' arrest for supplying alcohol to 17-year-old girl the day before the crash. As law enforcement probed deeper, they discovered evidence that the Hubbards, who were both associated with the Chilton County Board of Education, had a sexual relationship with the teen. David Hubbard was at the time working as the School Resource Officer at LeCroy Career Tech Center while his wife was a substitute teacher.
When news of the evidence became public, authorities said multiple students came forward to disclose details about how they had also been subjected to inappropriate and illegal contact with both Hubbards between 2013 and 2015.
Rebecca Hubbard entered guilty pleas in Aug. 2015 to two counts of second degree rape, one count of a School Employee having Sexual Contact with a Student Less than 19, one count of Enticing a Child for Immoral Purposes, and one count of a School Employee Committing a Sexual Act with a Student Less than 19.
Mrs. Hubbard's plea agreement included crimes against five victims.
Prosecutors recommended she be giving a 15 year sentence for each of the two counts of rape, 15 years for the one count of a School Employee Engaging in a Sex Act with a Student Under 19, and the maximum 10 year sentence on the one count of Enticing a Child for Immoral Purposes and maximum 1 year sentence on the one misdemeanor count of a School Employee Committing a Sexual Act with a Student Less than 19.
